SOIVRE safety control on garments and home textiles

Since 4 April 2026, much of the clothing imported into Spain goes through the SOIVRE safety control before customs clearance, or has to show that the control does not apply. This page sums up, heading by heading, what the Order says and what the file needs.

What changed and when

Orden PJC/161/2026 of 24 February, published in the BOE (the Spanish official gazette) on 4 March 2026, replaces the whole of annex I of Real Decreto 330/2008. That annex is the list of products from non-EU countries that go through a safety control before customs clearance, carried out by the SOIVRE Inspection Service. The Order came into force one month after publication: 4 April 2026.

The control is requested with an application to the SOIVRE service. The annex has two kinds of line: whole headings, controlled whatever the age or use of the garment, and "Ex" lines, controlled only for certain products.

Table A. Whole headings: always controlled

HeadingWhat it is
5703Tufted carpets and rugs
5704Felt carpets and rugs
5802Terry towelling fabrics and tufted textile fabrics
5811Quilted textile products in the piece
6107Knitted underwear, pyjamas, bathrobes and dressing gowns, men's or boys'
6108Knitted underwear, nightdresses, pyjamas, bathrobes and dressing gowns, women's or girls'
6109Knitted T-shirts and vests
6111Knitted babywear and accessories
6112.20Overalls and ski suits
6112.31, 6112.39, 6112.41, 6112.49Knitted swimwear
6115Tights, socks and other knitted hosiery
6116Knitted gloves, mittens and mitts
6207Woven singlets, underwear, pyjamas, bathrobes and dressing gowns, men's or boys'
6208Woven singlets, underwear, nightdresses, pyjamas, bathrobes and dressing gowns, women's or girls'

6301.10Electric blankets
6302Bed, table, toilet and kitchen linen
6307.90.93Protective face masks
6401 to 6405Footwear

For these headings there is no "no procede" (control does not apply). SOIVRE Note 2/2026 says so expressly for overalls and ski suits (6112.20): the whole heading is in the control, so there is nothing to declare as not applicable.

Table B. "Ex" lines: controlled only in some cases

On these lines the annex controls only children's clothing, workwear or personal protective equipment (PPE), depending on the heading. The 1429 column shows whether the line is in annex I of SOIVRE Note 2/2026, which allows self-declaration (see below).

The Order speaks of garments "for boys" or "for girls" without setting an age. SOIVRE Note 2/2026 uses an age limit of 14 to exclude self-declaration.

What is not in the annex

Not listed, among others: 6212.90 (corsets, braces, garters and similar), 6213 (handkerchiefs), 6214 (shawls, scarves and mufflers), 6215 (ties), 6217 (other clothing accessories), 6301 except electric blankets, 6303 (curtains) and 6304 (other furnishing articles). With no line in the annex there is no SOIVRE safety control and no "no procede" to show.

The "no procede" and code 1429

If a garment on an "Ex" line in chapters 61 and 62 is not for children, work or protection, the control does not apply, but that has to be shown at every clearance. The general route is an application to the SOIVRE service declaring that the control does not apply ("no procede").

SOIVRE Note 2/2026 opens a second route, self-declaration: the importer, or its customs representative, enters exemption code 1429 in data element 2/3 of the declaration (the old box 44) and files no application. It is valid only if all of this holds:

  • The importer is an Authorised Economic Operator (AEO) and, if a customs representative declares for it, the representative is an AEO too.
  • The importer is on the SGICATCE list of authorised companies. The list is not public; the tax agency (AEAT) has it.
  • The line is in annex I of the Note: 310 CN10 lines in chapters 61 and 62 added by the Order. It does not include 6112.20 or the other whole headings.
  • The importer's tax number (NIF) on the declaration is the same one it is listed under.

Even when authorised, 1429 cannot be used for children's garments up to age 14, young-adult garments in sizes XS, S, 34, 36 or equivalent, workwear, PPE or electrical and electronic equipment. For XS and S there is an alternative: include them in the self-declaration with a commitment to carry out a risk assessment under Delegated Regulation (EU) 2024/3173 (annex V of the Note). If there is reasonable doubt about the intended use of the garment, 1429 cannot be used.

To join the list, the importer applies to SGICATCE through the SOIVRE service of its regional or provincial trade office, with the annex II commitment and an internal classification protocol covering at least what annex III asks, and accepts the AEAT's checks. There is one authorisation per importer, valid for clearances anywhere in Spain.

What each container file needs

  • For each style, its heading, the same on the invoice, the packing list and the declaration.
  • For whole headings, the SOIVRE application reference.
  • For "Ex" lines, the control application if the garment is for children, work or protection. If not, the "no procede" application or code 1429, with the classification behind it: age, sizes and use.
  • The evidence for that classification: the size range on the packing list and the label of each style.
  • If 1429 is used, that no style falls into the exclusions: children, XS or S without the annex V assessment, workwear or PPE.

Cotejado checks the SOIVRE status of every style on every container: the heading, the age and the use declared on the label and the packing list, whether 1429 is available and whether the application is on file.
